These Terms and Conditions ("Terms", "Agreement") govern your access to and use of the ScanToReviewAI platform, website, and associated services (collectively, the "Service"). ScanToReviewAI is a product owned and operated by Cosolvix ("Company", "we", "us", or "our").
By accessing, registering for, or using the Service, you ("User", "Subscriber", "Business") agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service.
1. Description of Service
ScanToReviewAI is a B2B Software-as-a-Service (SaaS) platform designed to assist businesses in generating, managing, and facilitating customer reviews for their Google Business Profiles via QR codes, AI-assisted text generation, and routing mechanisms.
2. Acceptable Use and Platform Abuse
You agree to use the Service in compliance with all applicable local, state, national, and international laws. Specifically, you agree NOT to:
- Use the Service to generate fake, fraudulent, or incentivized reviews that violate Google's policies or applicable consumer protection laws (including the guidelines issued by the CCPA or the FTC).
- Reverse engineer, decompile, or disassemble any part of the Service.
- Attempt to bypass or exploit the Service's subscription tiers or location limitations.
- Use the AI generation tools to create offensive, defamatory, or unlawful content.
We reserve the right to suspend or terminate your account immediately and without refund if we determine, at our sole discretion, that you have violated these Acceptable Use terms.
3. Third-Party Platforms (Google)
ScanToReviewAI provides tools to facilitate the creation of reviews on Google Maps/Google Business Profile. However, we are not affiliated with, endorsed by, or sponsored by Google LLC.
Disclaimer of Liability: We do not guarantee that reviews generated or submitted through our Service will be published, retained, or positively impact your search engine ranking. Google's algorithms and review policies change frequently. We are not liable for any reviews being hidden, flagged, or deleted by Google, nor are we liable for any suspension of your Google Business Profile.
4. Subscriptions, Billing, and Payments
Access to premium features of ScanToReviewAI requires a paid subscription. By providing a payment method, you authorize us (or our third-party payment processors) to charge the applicable subscription fees on a recurring basis (monthly or annually) until you cancel.
It is your responsibility to maintain updated billing information. Failure to pay may result in immediate suspension of the Service. For information on cancellations and refunds, please refer strictly to our Cancellation & Refund Policy.
5. Intellectual Property Rights
All intellectual property rights in the Service, including but not limited to software, AI prompt matrices, UI/UX designs, algorithms, trademarks, and branding, are the exclusive property of Cosolvix.
You retain ownership of your specific business data and customer list. By using the Service, you grant us a limited, non-exclusive, royalty-free license to process this data solely for the purpose of providing the Service to you.
6. Limitation of Liability
To the maximum extent permitted by applicable law, Cosolvix and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the Service; (b) any conduct or content of any third party on the Service.
7. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.
Exclusive Jurisdiction: Any legal action or proceeding arising under these Terms will be brought exclusively in the courts located in Maharashtra, India, and the parties hereby irrevocably consent to the personal jurisdiction and venue therein.
8. Modifications to Terms
We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 15 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. Your continued use of the Service following the posting of any changes to the Terms constitutes acceptance of those changes.
